TSCOG supporters missing?

January 21 2011

I am wondering, PJ, have the TSCOG supporters bombarded Groklaw this time like
they have in the past?

I've checked the Yahoo! SCOGQ.PK message board, and there is not one single post
about how TSCOG is the harmed party and deserves to win. Even backinfullforce
(or any of his many aliases) has not shown up, and I thought he would go to his
grave posting comments favorable to TSCOG and then they'd put some on his
tombstone. When BIFF is gone, you know TSCOG is out of time.

At InvestorVillage's SCOQ.PK board, which is several shades more civil than the
Yahoo! board, no TSCOG supporters showed up either, but that is not unusual. No
supporter was ever well received there.

Clocks

January 21 2011

If you will recall last time, some folks came on here and
said some pretty ugly stuff about the accuracy of the report
from the appeals hearing.

Something we could really not do much about as only one
person (me) was there, reporting back to groklaw.

This time, we have 3 different people who weren't really
aware of each other (I did spot the third reporter but he
was quite intent on the hearings and his notes and I didn't
approach him) and thus have 2 verifications of the others'
observations.

I have reviewed the other two reports as they were posted
and certainly dont have objections to make, and I assume
they laid as critical an eye on my observations.

This time I know there were a few key phrases that I
remember coming one way or the other I didn't get scribbled
in time but rather than try to force the inclusion and risk
inserting it in the wrong place or mis-remembering the exact
phrase, I have included a disclaimer about lack of
completeness and put forward the version that is best
supported by my notes.

Its nice to have some others' observations to supplement
what I was not able to immediately write down and also to
provide a confirming perspective about some of the finer
points I was concerned I had missed.

The odd transition into discussion about parole evidence,
for example. I wasn't the only one who missed how in the
world we ended up there.

This time there isn't much the trolls can do because someone
challenging one of our writing is as simple as PJ emailing
one of the other authors independently to confirm.

I think I exchanged a few words with turner outside the courtroom after the
hearing but I don't think that Clocks and I talked much. But I may have the
individuals backwards.

Did you tell me that you were there as an observer, and did we discuss Judge
Holmes' ability to shred each side of an argument? I was wearing a black shirt
with white stripes, and have long grey hair and beard.

Yes that was! I wondered if you might be one of us. The notebook was the
giveaway. If there is a next time, we should get together early for breakfast.
Of course, that would be a lot easier if a next time were in warmer weather. :)
Did you notice that the attorney who came back in after his appeal and sat down
next to me kept looking at me and my notebook, obviously wondering who I was and
what was I doing? I guess we must be a bit of an oddity, people who are
passionate about a case, and go to court to take notes and report.

Reports from the Courtroom: Oral Argument at 10th Circuit Court of Appeals - SCO v. Novell

charlie Turner

January 23 2011

With respect to Mr. Jacobs being the first to shake hands, I would be completely
remiss to not mention that after court was adjourned, I was out in the hallway,
talking to people, when a group of people came out of the courtroom and one of
them asked: "Is anyone here from Groklaw?" I spun around and said:
" Yes, I'm charlie Turner, with Groklaw." He stuck his hand out,and
said: "Michael Jacobs, Morrison Foerster. Before I had a chance to even
take that in and totally freak out, he continued: "What did you think of
today's hearing? I mentioned that compared to the last one I attended, the June
15th '09 bk hearing in Wilmington, this one went so fast I really couldn't take
good notes. He rolled his eyes, and made a couple of facial expressions that
told me he well remembered that well oiled train wreck. One of the other MOFOs
said they looked forward to reading my report, and they walked off, leaving me
standing there shaking a bit, and wondering if that just really happened. :)!
