if you read it carefully you might find that all the obfuscations by scox has been for this part here.
it is all about control of the contract .i dont know if wells made a mistake or not but i see what scox is trying for.and they may just be able to make this arguement.the only good thing is when PSJ's are allowed to be filed.then we will get to see what IBM lawyers are made of.
they will have to really be very specific and pin down issues.i expect tons of them.

I think this really is the first time we've gotten SCO's theory of the case from SCO in a form that was human-readable (sorry, BIFF, you don't qualify).

The interesting bit is that the Echo newsletter, among other things, pretty clearly blows up any hope of this theory holding water. This filing stinks of desperation -- SCO is starting to make sense only when they feel their case will be thrown out if they keep talking gibberish.

agreed but it still means that the only way to deal with these claims may be PSJ's if i am understanding the process?
that is what is sad about this.kimball might overturn for this argument just because he hasnt ruled on the contract issue?

What you're saying makes sense, yeah. These may actually be dispositive issues that have to be sorted out on PSJ.

That's kind of a bummer.
